Terms and conditions
(Please note that clauses 2 & 3 are only applicable on the provision of Ensurent’s Rental Guarantee and Collection services)
- 1. Landlord/Lessor membership has a mandatory annual cost of R195 (Excl. VAT) for which the Landlord/Lessor is liable for, irrespective of additional services such as rental guarantee and/or collection that he may/may not take in the future.
- 2. All the provisions of this agreement shall be severable and no provision shall be affected by the invalidity of any other provision;
- 3. This agreement, with its different sections, terms and conditions and forms shall be read to form one agreement between the Landlord/Lessor, Tenant/ Lessee and Ensurent and only be binding upon the signature of the Ensurent Services Form by the parties, alternatively representatives of the Landlord/Lessor and the Lessee.
- 4. In the event that the signatory accepts this agreement in a representative capacity, then such person warrants that he or she is duly authorised thereto.
- 5. The signatory to this agreement verifies that he has read, understood and agreed to be bound to the terms and conditions and declare that the information given herein is true and correct.
- 6. The signatory to this agreement hereby grants Ensurent consent at all times to request information from any persons, credit bureaux and/or businesses
- 7. In the event of the Landlord/Lessor and/or Lessee defaulting, the parties understand that they will be liable and responsible for any outstanding amounts to the Company.
- 8. Any information given by a signatory, which is fraudulently and/or purposefully given to mislead the Company, will be seen as an unlawful act and the Company reserves the right to prosecute such party criminally and shall deem the agreement to be null and void.
- 9. Should the Landlord/Lessor and/or Lessee default in any manner whatsoever, the Company reserves the right to submit such information to Transunion ITC or a similar company to list such a party as a default payer and to enforce the terms of this agreement by instituting legal action against such defaulting party and where appropriate, the Company reserves the right to prosecute such defaulting party criminally.
